Michael Horner is considered one of the best DUI (Driving Under the Influence) lawyers in the Santa Clara County and California. He has been a member of the firm of Hinkle, Jachimowicz, Pointer & Emanuel since 1987. He holds a Bachelor's Degree in Political Science, and a Master's Degree in American Government, as well as a Juris Doctorate Degree.
From 1973 to 1987, he served as a Legislative Assistant to Senator Alfred Alquist. He is a member of Fellows of Lincoln University, an organization he co-founded in 1983. He volunteers his time in many legal and community service organizations.
Mr. Horner has emphasized the practice of drunk driving, motor vehicle cases and DMV cases, including felonies and misdemeanors since1987. He is a member of the California DUI Defense Attorneys Association and has successfully defended thousands of DUI and DMV cases. He is considered a pioneer in the defense of blood cases at Admin Per Se hearings at the DMV. His work before the Department of Motor Vehicles has helped insure that motorists charged with driving under the influence receive proper and medically approved venipuncture after their arrest and that any breath test given meets vigorous standards of testing. He is a text book of Motor Vehicle law and serves as a mentor to other attorneys on the subject of drunk driving and Department of Motor Vehicle cases. He also served as a Pro Tem Commissioner in Superior Court for Santa Clara County, which gives him a wide view on the administration of justice on that level.
He is one of the few DUI lawyers in San Jose who fights at in-person hearings to save the licenses of his clients who are facing suspension. He is well respected by his peers, police officers, DMV officers, judges and prosecutors.
He is an avid photographer and collector.
